TN Expungements: There are many benefits to clearing your record.

Posted April 10, 2014Lee Martin - Felony Cases, Misdemeanor Cases

If you have a prior conviction for either a felony or misdemeanor charge, you have probably experienced the negative effects that a criminal conviction carries.  You have probably lost both educational and job opportunities, not to mention the negative social stigma associated with a criminal record.  A criminal conviction clearly carries a price and there may be means to having your record sealed from public view.  Tennessee has expungement laws that allow you to clear your record.  If you qualify, your record can be wiped clean and you can start with a clean slate.  Any opportunity to clear your record should be taken advantage of because there are many positive effects that could change your life.

If you are able to get your record expunged, you could benefit in many ways.

  1.   Job opportunities could increase due to the fact that many doors previously closed will now open up.  A recent 2012 study found that 87% of all employers conducted criminal background checks.  Remember, they are doing these searches for their health and any negative information will be used against you.  I have found that many reputable employers will not hire any employee with a prior criminal history.
  2. You may be eligible to legally own and possess a firearm.  Certain felony and misdemeanors like domestic violence make it illegal to own a firearm.  However once your record is cleared of these charges, you can then become eligible to own and possess a firearm.
  3. Federal financial aid programs and educational opportunities could also finally open up.  In 2010, 66% of all colleges conducted criminal background checks on its applicants and many candidates were rejected due to these checks.  Likewise, federal financial aid programs prohibit funding to students with certain types of offenses like drug charges.  This benefit alone could have the most positive effect on your life.  You can now take charge of your life and find the career suitable to your talents.
  4. You chances of adopting a child are increased when your record is clean and free from criminal convictions.  Unfortunately, I have received a number of calls from hopeful couples who were denied an opportunity to adopt based upon a prior conviction by one of the parties.  Now with a clean record, their ability to adopt is dramatically increased.
  5. The social stigma associated with a prior criminal conviction will finally be lifted and no longer pose a burden on your life.  After having their record expunged, many people simply feel better about their future and prospects.  I have found this to be the case in many instances and this is extremely rewarding from my perspective.  It is always rewarding to see a satisfied client who is changing their life around.

There are many fine points to Tennessee’s expungement laws and this is intended only as a general outline.  It is well worth investigating to see if you are eligible to have your record cleared.  If you need help having your record expunged, give criminal defense attorney Lee Martin a call at 615-345-1988
