  2. When you are under the influence of alcohol. You do not always have to have a BAC above .08 in order to be charged with DUI. The key is whether you are impaired or not. In addition, young people, who are subject to zero tolerance laws and commercial drivers have lower permissible blood alcohol content.
  3. When you are under the influence of drugs, including prescription or legal drugs. It can be more challenging for police to make a case for drugged driving because there is no clear baseline standard similar to a .08 DUI. Further, some drugs stay in your system for a long time after you have used them, so drugs in your blood stream do not necessarily mean you are high.
  4. When you are under the combined influence of drugs or alcohol.

To be charged with DUI for any of these behaviors, you must have been in physical control of a motor vehicle and you must have been travelling on a public road at the time when you were driving while impaired.
